Hi John, my name is Shira Feldman, and I'm the director of constitutional litigation at Brady. That means I lead Brady’s Second Amendment litigation and its amicus work. I represent state and local governments whose gun violence prevention laws are being challenged in court and advise them on strategies for responding to such legal challenges.

Should the courts take action to uphold gun safety?

One of the cases my team and I have been working on is Garland v. VanDerStok in the Supreme Court — the so-called "ghost gun" case.
|
Right now, very few states regulate ghost guns — dangerous, untraceable firearms without serial numbers that almost anyone can assemble from parts bought online or made with 3D printers. Garland v. VanDerStok is a challenge to a Bureau of Alcohol, Tobacco, Firearms and Explosives rule regulating these guns at the federal level.

The Supreme Court’s decision will determine whether our country is able to save countless lives — or whether more firearms used primarily in crimes are put on our streets.

And that's just ONE case — Brady is involved in legal battles all over the country, from appeals courts to district courts, fighting to end gun violence.

The battles are never easy, but many times we can achieve live-saving wins in the courts: in August, the Eighth Circuit Court of Appeals affirmed a lower court decision blocking a Missouri law that had declared federal gun laws invalid, blocked state and local officials from helping enforce federal gun laws, and subjected them to penalties for doing so. That was a HUGE victory for our movement, and hard-won.

And, John, win or lose, Brady will never stop fighting, because we believe that the fight for gun safety extends from the courthouses to the legislature to our communities.
