Today is a critical day for democracy in America. Our fervent hope is that all Americans can safely and freely cast their vote, and that election workers can do their job without fear or threats.
We are mindful that the days ahead may bring election-related lawsuits. Already, over 100 lawsuits have been filed addressing efforts to further restrict voting access, purge voter lists, and otherwise affect the rules of the voting process.
We respect the right of anyone to seek redress through the courts. But we also believe that lawyers have an obligation to ensure that any filed claim is substantiated by facts.
Over the last several years, LDAD initiated a number of ethics complaints against lawyers who strayed from the rule of law and the requirements of their oath in their efforts overturn an election. Some have since been disbarred or suspended; others are currently facing disciplinary proceedings.
Last evening, U.S. News published a letter from more than 130 current and former bar association presidents, (including members of LDAD's board), reminding lawyers that their obligation to the Rules of Professional Conduct requires that election-related lawsuits have a solid foundation in facts that are supported by the law.
As lawyers, it is our sacred obligation to safeguard the rule of law. This responsibility drives us each day, and we know it drives the work of most of our nation's lawyers. Here at LDAD, we remain optimistic about our country's future, and we will continue working each day to protect democracy and our justice system.
