Home and Community Services Rulemaking Notices October 2024

The Department of Social and Health Services (department), Aging and Long-Term Support Administration Home and Community Services division filed rules with the Washington State Code Reviser's Office in October. CR-101 PreProposal Statement of Inquiry

The department is considering amendments to sections WAC 388-71-1055 What are the minimum qualifications for an instructor for basic (including 30-hour and seven-hour DDA parent providers), population specific, on-the job, nurse delegation specialized diabetes trainings? WAC 388-71-1064 What are the minimum qualifications for community instructors for adult education training using DSHS curriculum, WAC 388-112A-1240 What are the minimum qualifications for community instructors for adult education training using DSHS curriculum, and WAC 388-112A-1250 What is the minimum qualifications for community instructors for adult education training using DSHS The amendments are related to the minimum qualifications for an instructor for adult education, nurse delegation core, and specialized diabetes trainings when the instructor only teaches at the facility or corporation where they are employed. Other necessary changes and corrections related to numerical representation, consistency, and inclusive language may also be included. Filed as WSR 24-22-012 on October 24, 2024.

CR-102 Proposed Rulemaking

WAC 388-106-1021 Private Duty Nurse Holiday Pay. The proposed rule clarifying holiday pay for contracted private duty nurses. Filed as WSR 24-21-156 on October 22, 2024.


CR-103E Emergency Rulemaking

The department is amending WAC sections 388-71-0523, 388-71-0880, 388-71-0888, 388-71-0890, 388-71-0977, and 388-115-0523.  The purpose of these changes is to bring rules into compliance with Senate Bill 5811(chapter 322, Laws of 2024). This rulemaking expands the definition of individual provider. This is the second emergency rule. Filed as WSR 24-22-004 on October 23, 2024. Effective date is October 26, 2024.
