Dear Patriot, Earlier today, the Senate began consideration of amendments to H.R. 6172 -- Speaker Nancy Pelosi's (D-CA) and Senate Majority Leader Mitch McConnell's (R-KY) phony “reforms” of the USA FREEDOM Act (previously known as the USA Patriot Act). McConnell planned to hold votes today on two competing amendments. His own -- which would explicitly grant the FBI power to seize your Internet search and browsing history. And the Wyden-Daines Amendment -- a good step toward rolling-back the surveillance state, it would require the government to present probable cause to a court prior to getting access to your Internet browsing history. Neither was adopted, but more votes are coming tomorrow and the next 24 hours will be crucial. For today, the silver lining is, thanks to liberty-loving patriots like you, Senator McConnell backed off his amendment (at least for now). Even better, the fact that the Wyden-Daines Amendment came within just ONE vote of McConnell's 60-vote threshold for passage of the amendment, means you and I could see real reforms if we turn up the heat. This is an opportunity to land some real blows (maybe even a deathblow) on the Deep State's blatantly unconstitutional warrantless domestic surveillance programs. But we have to keep the heat pouring in over your Senators' phone lines! You see, tomorrow the Senate will vote on an amendment offered by Senator Rand Paul (R-KY), that would forbid the use of the FISA court to obtain permission to spy on any American citizens. Instead, federal agencies would have to go before a federal court and obtain a warrant. 202-224-3121 Since its creation in 1978, the FISA court has served as little more than a rubber-stamp for federal agents seeking a way around the Constitution’s requirement that they obtain a warrant before spying on American citizens. Recent revelations about how FISA’s procedures were mismanaged during the investigation of former National Security Advisor Michael Flynn shocked even snoop state supporters like Sen. Lindsay Graham (R-SC). So, no senator has any excuse to vote to allow the FISA court to continue to be used to get around the Fourth Amendment!Like the Wyden-Daines Amendment, the Paul Amendment offers a good step toward rolling-back the surveillance state. However, even if adopted, H.R. 6172 still gives snoop state bureaucrats power to “monitor” our online activity and our personal and professional activities. For instance, the bill reauthorizes roving wiretaps, where a warrant is issued to collect information on any device a suspect may use — even information of other users of the device. So, if you are at a hotel with someone under surveillance and you both use the hotel’s business center computer, your online activities will be collected by the federal government, and you may even be a target of government surveillance. Just being on the same wireless network as a suspect at the hotel could result in your data being captured by the government. There’s also the “lone wolf” provision that allows federal agents to conduct warrantless surveillance on an American citizen even though they have no known or suspected ties to any terrorist organizations!
