James, we’ve been working for months to get the 10 abortion ballot initiatives over the finish line.

Here is where we stand with all 10 states, just 2 days out from Election Day.

Arizona: Right now, a 15-week ban is in place in Arizona. With 50% of the vote, the new limit would be 24 weeks with exceptions for the mother’s health. Recent polling has the measure garnering 58% support.
Colorado: Colorado is a crucial state for access across the West. Their current laws already protect abortion, but their ballot measure would enshrine reproductive rights into the constitution and allow state dollars to be used on abortion care. This measure requires 55% of the vote.
Florida: A six-week ban is currently the law in Florida. If the ballot initiative passes, abortion would be protected by the constitution up until fetal viability and after for the health and safety of the mother. Governor Ron DeSantis has done everything in his power to sabotage the measure. A simple majority is not enough to pass an initiative in Florida, you need 60% support. Not only would the passage of this measure improve access for Floridians, but also the entire south which has some of the most archaic bans in the country.
Maryland: Maryland’s ballot measure enshrines “reproductive rights” into the constitution, and only requires a simple majority to pass. Maryland is one of the best states in the country when it comes to abortion access.
Missouri: A total abortion ban is in place in Missouri. Republicans did everything they could to prevent abortion rights from being on the ballot in Missouri but thanks to the hard work of advocates on the ground,Amendment 3 will appear on the ballot. A simple majority would enshrine the right to reproductive freedom into the state’s constitution.
Montana: Abortion is currently legal up until fetal viability in Montana. However, Republicans have attempted multiple times to restrict access, which makes this ballot measure critical. With 50% of the vote, the right to make and carry our decisions about one’s own pregnancy will be in the state’s constitution.
Nebraska: Nebraska has two ballot measures regarding abortion rights. One initiative bans abortion after 12 weeks, which would also pave the way for a total abortion ban. The other would guarantee abortion rights up until fetal viability with exceptions for the health and life of the mother. Republicans hope voters are confused and that’s part of their plan to restrict abortion rights in the state. If both ballot measures pass, then the one with more votes will become law.
Nevada: Their ballot initiative aims to enshrine the right to abortion into their constitution. This vote is the first step to amending the constitution, in order to be officially added the measure would have to once again be passed in 2026 with 50% of the vote.
New York: The New York amendment isn’t just for abortion rights, it also aims to enshrine equal rights regardless of gender. Abortion rights are a key part, but it also borrows heavily from other Equal Rights Amendments. With 50% of the vote, this amendment will become law.
South Dakota: South Dakota has one of the most extreme bans in the country and the ballot initiative would expand access with restrictions depending on the trimester. This amendment requires a simple majority to pass.
