Although many bills are not moving forward this year, A Voice for Choice Advocacy is excited to share that AB 1989, our bill which Assembly member Cristina Garcia authored to label Menstrual Product ingredients: AB-1989 Menstrual Products Right to Know Act of 2020 is moving forward.  Women are exposed to many toxins in their menstrual products , potentially leading to cancer, reproductive damage, allergic reactions and hormone disruption.  This bill would require that all ingredients in menstrual products, from tampons to sponges to menstrual underwear, become publicly available to consumers.  In Garcia’s words, “If we are using these products, we should know what we’re putting in our bodies.  If it’s a tampon, pad, a cup, Thinx underwear, no matter the product, I want you to have the best xxxxxxrmation out there.”  See attached Fact Sheet for more details.

NY state passed a similar Menstrual Product Labeling bill into law last year (https://www.vogue.com/article/new-york-menstrual-period-product-labeling-act).  AB 1989 takes this bill further, not only requiring all ingredients to be labeled, but also specifically requires ingredients that are on either US and EU toxic chemical lists to be listed, even if they are part of Confidential Business xxxxxxrmation (CBI, aka trade secrets).  Note: The sponsor of the NY bill, Women’s Voices of the Earth, is not currently supporting this bill because they believe it does not go far enough.  We disagree, as this bill actually goes further than the NY bill, and also feel that this bill has to move forward this year because every woman has the right to know what is in her menstrual products NOW.  The passing of this law, along with the NY law, will guarantee that manufacturers will label be forced to their products nationwide.  Women deserve the right to know what goes into their body, rather than waiting for a perfect bill which will not pass the legislature.
