John, this new lawsuit is coming just days after the Department of Justice put Musk on notice – informing him that they’re eyeing his $1 million a day voter lottery scheme as a potential federal crime. [2]
That’s because it’s illegal to pay – or otherwise financially incentivize – people to register to vote (and vote). And when you tack on that his offer is only available to swing state residents who agree with his politics, it’s easy to see why the DOJ is on alert. [3]
Bribing voters is illegal for good reason. The idea of “one person one vote” goes out the window if one billionaire can use his wealth to sway how others cast their ballots.

More and more, the wealthy and powerful are wielding their fortunes to sway our elections. That’s why 2024 will likely be the most expensive election in history, with spending expected to top $15.9 billion. [4]
And while the disastrous Citizens United decision opened the door for billions of dollars to flood our elections, we still have some strong laws on the books to prevent bribing anyone to register to vote or vote for a certain candidate.
And as the Department of Justice warned him last week, Musk’s activities may well violate those laws. Even though he has tried walking back the most egregious parts of his scheme, the lottery is still open only to people registered to vote in seven battleground states. [2]
Our democracy is built on the simple principle that our vote is our voice – and every voice should count the same amount. We can’t allow those with financial power to buy a bigger say at the expense of everyday Americans.
