STATE ENGINEER’S OFFICE FINAL OPINION OF THE WATER SUPPLY AND WATER YIELD ANALYSIS FOR DRY CREEK TRONA PROJECT – ALTERNATIVE D, SWEETWATER COUNTY, WYOMING NOVEMBER 2024 The State Engineer’s role in industrial development and siting is outlined under Wyoming Statute (W.S. § 35-12-108). If an applicant for an industrial siting permit plans to construct a facility which will use more than 800 acre-feet (260.7 million gallons) of water per year, the applicant must submit a water supply and water yield analysis to the State Engineer. The State Engineer will then review the analysis and “render a preliminary opinion as to the quantity of water available for the proposed facility” (W.S. § 35-12-108(c)). Pursuant to W.S. 35-12-108, the State Engineer’s Office published the preliminary opinion once a week for three consecutive weeks in the Green River Star (i.e., September 19th & 26th, and October 3rd, 2024). Before rendering a final opinion as to the quantity of water available for the proposed Dry Creek Trona Project – Alternative D, the State Engineer provided a 20-day period after the last date of publication which ended on October 23rd, 2024, for the submission of written comments. The only comment received was a letter from the Wyoming Game and Fish Department. That letter and the SEO response are available as Appendix A of the final opinion.
