Equal justice under law.

The words are etched across the face of the Supreme Court. They reflect our core values as a country and, by virtue of their place above the highest court in the land, they remind us that our values are something to fight for.

And we need to fight right now. Last week, Attorney General Bill Barr’s DOJ took the shocking and unprecedented step of moving to dismiss the charges against former National Security Advisor Michael Flynn—who is being elevated as a martyr for the president’s illiberal cause despite being disgraced and fired by President Trump in 2017.

Barr recently lamented that groups who “usually worry about civil liberties and making sure that there’s proper procedures followed and standards seem to be ignoring it.” That’s false, and Barr knows it. Those groups are raising hell over Flynn’s dismissal and other DOJ conduct specifically because they violate all processes and standards. American Oversight is proud to stand among them.
 
First, just days after Barr’s DOJ moved to dismiss the charges against Michael Flynn—despite his two guilty pleas, white shoe attorneys, and ample evidence—American Oversight sued to force DOJ to release documents about political interference in the case. As we argue, if Barr wants us to believe the dismissal was in the interests of justice, he has a lot more explaining to do. We’re going to force his hand.

Second, we published an article in Just Security and Slate flagging how the federal court in DC has the opportunity to restore the integrity of the US Attorney’s office in DC in the wake of the actions of the current acting head of that office — a prosecutor handpicked by Barr who was behind not only the Flynn dismissal but the drastic reversal earlier this year in the sentencing recommendation for Roger Stone. We argue the court should exercise its discretion to replace acting US Attorney Timothy Shea with a trusted, career prosecutor without ties to political leadership.

Finally, we outlined a roadmap for how investigators in Congress, the press, and watchdogs like American Oversight should use the Flynn case to expose the systemic perversion of justice at DOJ under Barr’s leadership. 
 
America’s founding principles are worth fighting for. Acquiescing to brazen acts of partisan justice will only breed impunity in this administration and, if it goes unchecked, administrations to follow. We are in it for the long haul. We invite you to follow along and to fight back with us.
