In early September, CREW filed an amicus brief explaining why Judge Aileen Cannon needs to be reassigned in the federal classified documents case against Donald Trump. Since then, we’ve only seen more ethics issues and reasons for her removal.
A couple of weeks ago, we learned that she failed to disclose attendance at right wing junkets which violated ethics rules and called her judgment into question.
But this week, there’s even more alarming news:
ABC: Judge Aileen Cannon, who tossed Trump's classified docs case, on list of proposed candidates for attorney generalJohn, now that Judge Cannon is reportedly being considered as a potential attorney general in a second Trump administration, it's even clearer that she can never be impartial in the classified documents case.
After all, how could she possibly be impartial knowing the defendant is considering her for the job of attorney general?
This only adds more urgency to the argument we made in our brief last month.
A prominent retired federal judge and two leading constitutional scholars joined our legal brief because the facts are clear: Judge Cannon’s overwhelming appearance of bias in Trump’s favor, her disregard of existing precedent and her inability or unwillingness to avoid delay and move the case forward are more than adequate grounds to reassign the case.
So today, we have a reminder: If the Court of Appeals reverses Judge Cannon’s decision in the federal classified documents case, it must also remove Judge Cannon from the case, and reassign it so the case can proceed fairly and quickly.
Judge Cannon slow-walked this case, made it more difficult than the law mandated and then dismissed it. But CREW believes in fighting for accountability, and that’s why we believe she needs to be removed from the case.
