Almost one month ago, the Georgia State Election Board passed some truly impossible rules to implement, including one mandating the hand counting of all ballots cast on Election Day.

Today, I’m emailing to let you know that several of those rules have been defeated in court—and we were proud to be a part of that work.

The Georgia Supreme Court declined to allow several damaging last-minute election rule changes on Tuesday. The decision cements a recent court victory against that hand counting rule—which CREW and our co-counsel are proud to have helped secure.

CREW filed a brief in the Georgia Supreme Court on behalf of the Cobb County Board of Elections and Registration in Eternal Vigilance Action v. Georgia along with co-counsel Caplan Cobb LLC, and Haynie, Litchfield & White, PC, which builds on a victory we obtained last week in the Fulton County Superior Court in Cobb County Board of Elections and Registration v. State Election Board .

That ruling blocked the hand count rule, which would have required poll workers to hand count every ballot (not vote) cast following the close of polls on election night and would have created confusion and disorder in the post-election period.

These last-minute rule changes were opposed by everyone from Georgia’s Republican secretary of state and attorney general to the Georgia Association of Voter Registration and Election Officials because they would have undermined the integrity of this year’s election in Georgia.

These cases are not about politics, but about protecting election officials and voters from chaos on election day and immediately after it.

We are grateful to the Georgia Supreme Court for this decision, which will help protect against chaos and disorder in the election. Meanwhile, there are still three rules in the Cobb County case that the court has yet to rule on, and a decision is expected in the case soon.
