This Halloween, here’s what’s really scary: If Donald Trump wins the White
House, he doesn’t need an act of Congress to ban abortion nationwide.
Instead, Trump and his extremist Project 2025 allies will enforce an 1873
zombie law passed before women could even vote.(1)
The far-right wing, including several Trump-appointed judges, believes the
Comstock Act can be used to stop abortion across the country.(2,3) That’s
why we’re pushing Congress to repeal this antiquated law once and for all.

anti-abortion Comstock Act?
In 1873, Congress passed the paternilistic Comstock Act to stop the U.S.
Postal Service from mailing any material deemed “obscene,” from romance
novels to Walt Whitman’s Leaves of Grass to anything having to do with
abortion.
The 150-year-old law was never popular and seldom enforced. The Post
Office, Congress, and the courts all generally agreed it no longer applied
to contraception or abortion.(4)
But it’s still on the books, and right-wing extremists now want to use the
Comstock Act to shut down abortion care nationwide.
Republican AG’s are evoking the zombie law in litigation against the
abortion pill.(5) Project 2025 is plotting executive action. And
Trump-appointed judges stand ready to throw out precedent to go along with
the plan.(6,7)

our petition demanding Congress repeal this 150-year-old law and protect
abortion and contraception rights across the country?
