On Monday October 2nd, President Joe Biden’s administration announced an updated proclamation and a final rule to further restrict asylum access at the southern border, which expands upon restrictions already in place. 

Now, the asylum ban can only be lifted if the seven-day average of people stopped at the border stays under 1,500 encounters per day for 28 consecutive days.  In addition, this new rule includes unaccompanied children in the asylum ban’s “daily encounter” count. 

These changes increase the likelihood that the numbers will exceed the daily threshold and asylum ban restrictions will continue, making it nearly impossible for most people to seek asylum at the southern border without an appointment.

On Wednesday, October 2nd, the Young Center  released the a fact check sheet in response to claims made during the Vice-Presidential Debate which alleged that the Department of Homeland Security had "effectively lost" 320,000 children.

In reality, the Department of Homeland Security released a report in August 2024 stating that 32,000 migrant children did not appear for their scheduled immigration court hearings between 2019 and 2023. The report also indicated that DHS failed to file notices of court dates for an additional 291,000 migrant children who had not yet had their hearings as of May 2024. The report did not find that the children were “effectively lost,” victims of sex trafficking or being used as drug mules.  

On October 10th, the 5th Circuit Court of Appeals in New Orleans will hear two crucial cases brought forward by anti-immigrant officials in Texas and other states who are hellbent on attacking immigrants. The first case is a continuation of Texas’ years-long effort to dismantle DACA while the second is a simultaneous effort to stop the ‘Keeping Families Together’ program from ever getting off the ground.

Program seeks volunteers to advocate for unaccompanied minors in US custody (Rafael Carranza, Arizona Republic) 

Charles Rogers recalled watching on the news when during a stretch from December 2018 to May 2019 at least seven migrant children had died while they were in the federal government's custody along the U.S.-Mexico border. He had traveled to Latin America for his job over the past 20 years and had become familiar with some of the challenging conditions that had forced children and their families to leave their homes and make their way to the United States. "They were trying to escape that kind of situation to survive. And then, the end of their story was before it even had started," Rogers said. Encouraged to find a way to do something, he heard about a volunteer program with the Young Center for Immigrant Children's Rights. He looked into it and decided to become a child advocate for unaccompanied minors.
