Whistleblowers Reveal Biden-Harris DHS’s Alarming Refusal to Collect DNA from Millions of Migrants
In a shocking revelation, whistleblowers have accused the Biden-Harris administration's Department of Homeland Security (DHS) of refusing to collect DNA from millions of migrants crossing the U.S.-Mexico border, directly violating federal law. The allegations, brought to light through a letter signed by more than two dozen Republicans in Congress, point to a blatant disregard of the DNA Fingerprint Act of 2005, which mandates federal agencies to collect DNA samples from foreign nationals detained by the government.

This law was reinforced under the Trump administration in 2020, but according to whistleblowers, the current administration has lawlessly suspended federal enforcement in the Harris “decriminalization” effort, creating a public safety nightmare!
Refusal to Collect DNA: only 16% of the 1.9 million migrants encountered in 2021 had their DNA collected and by 2022, this figure rose only slightly to 37%. As of 2023, the numbers remain equally dismal, with DNA collected from just 36% of 2.3 million individuals despite ballooning numbers of migrants entering the U.S.
Refusal to Collect Fingerprints: In addition to the failure in DNA collection, whistleblowers have raised concerns about the lack of comprehensive fingerprinting among migrants detained at the border. According to federal guidelines, the U.S. government must collect biometric data, including fingerprints, from non-citizens during the border enforcement process. Fingerprinting is crucial in identifying individuals with criminal records or prior deportation orders, enabling law enforcement to track repeat offenders or criminals more effectively. However, whistleblowers report that, under the Biden-Harris administration, the collection of fingerprints has been inconsistently applied or delayed, further weakening the security protocols at the border. Without proper enforcement of fingerprinting procedures, individuals who could pose significant risks may continue to slip through the cracks of the system unnoticed.
The ramifications of this refusal are not merely bureaucratic—they are tragically fatal. Among the most horrifying cases linked to this failure is the story of Victor Antonio Martinez-Hernandez, a Salvadoran gang member who allegedly raped and murdered Rachel Morin, an American citizen, and committed other violent crimes. Martinez-Hernandez had been apprehended by border patrol agents three separate times in early 2023, but DNA was never collected during those encounters. He evaded detection entirely on his fourth illegal crossing, ultimately leading to devastating consequences.
Had the DHS followed federal law, whistleblowers argue, Martinez-Hernandez’s DNA would have been logged in the FBI’s Combined DNA Index System (CODIS), potentially preventing these heinous acts. Whistleblower accounts suggest that DHS’s refusal to comply with DNA collection requirements is tied to the administration's broader failure to address the border crisis effectively. Over 10 million encounters with illegal immigrants have been recorded in just three and a half years, with another 2 million having crossed the border undetected.
Perhaps even more troubling is the retaliation faced by whistleblowers who exposed these violations. According to the letter sent by Republican lawmakers, whistleblowers such as Mr. Jones, Mr. Taylor, and Mr. Wynn have faced severe consequences for speaking out, including the loss of retirement benefits after 30 years of service. Some whistleblowers have even alleged that DHS officials within the Biden-Harris administration have made violent threats against them, aiming to "bankrupt [them], make [them] quit, die, or kill [themselves]."
