The Oct 8 Elections Commission meeting to address the Sunshine Law violation.

Here is the Background:

The Automatic Elections Commission meeting notification numbers increased in the number of people requesting notification of the Election Commission meetings (i.e agenda pdf, link to attend). See the increase in numbers below:

* January - 74

* February - 76

* March - 79

* April - 81

* June- 179

* August -377

The August 27 Meeting the link was switched the morning of the meeting. After highest ever interest in the meetings.

Automatic notifications were not resent with the proper link.

Chair Mike Curtis was asked over ten times by commissioners and testifiers to address the changed link. Each time Mike Curtis ruled the inquires out of order.

Deputy Attorney General Yee sat next to Mike Curtis in the meeting and did not address the issue either.

Complaints filed to office of information practices.

Meeting called on October 8th called to address sunshine law violation. No other issues were put on the agenda. 436 people signed up for notification.

Below are the questions that the Elections Commission asked the Attorney General to answer (So far the AG has not):

1. Answer in writing if the CEO had the authority to change the voting method to in person day of voting, IDs required, no machines in the precincts hand counting the paper ballots.
2. Answer the question of primary ballot constitutionality and follow up in writing within 5 days.
3. Answer in writing the legality of writing a certificate of election for the Governor and Lt. Governor prior to the 2022 election being certified (see the timeline below).


Be aware of these issues below:


Currently, there is NO Ballot box Chain of Custody. Counties do not keep Drop Box or USPS chain of custody contrary to law.

Signature Verification is done in Secret. If its not transparent it’s not credible (i.e. no official observers are allowed to observe what transpires in the signature verification process).

Post Election Audits are done with ballot Images. Both Chair Curtis and Scott Nago admit Ballot Images can be Manipulated. Audits must be done with original paper ballots.


** How was it possible for there to be an inauguration before the 2022 Election was certified?

A motion passed in the August Election Commission meeting for the Deputy Attorney General to answer to the legality of writing a certificate of election for the Governor and Lieutenant Governor prior to the 2022 election being certified.
