NCLEJ has filed a lawsuit against the employers of 24-hour homecare workers for illegally underpaying their employees.

Dear Friend,

NCLEJ has filed a lawsuit against the employers of 24-hour homecare workers for illegally underpaying their employees by only compensating them for 13 hours for their 24-hour shifts. We are suing GreatCare Inc., CenterLight Health System, Inc., and one or more managed long-term care plans (MLTCs) under contract with the New York State Department of Health (NYSDOH).

The exploitative conditions set by CenterLight and the MLTCs, and enforced by GreatCare, resulted in the substantial wage theft of 24-homecare workers, the majority of whom are Chinese immigrants who have limited fluency in English. These organizations have been able to evade scrutiny for far too long, and by holding them accountable, we can eliminate a huge engine that drives wage theft against homecare workers.

This lawsuit is the latest action in our multi-year struggle to secure restitution for homecare workers who experience unconscionable levels of wage theft and in some cases permanent disability because of their working conditions. We are also suing the New York State Department of Labor (NYSDOL) to force them to reopen their investigation into hundreds of unpaid wage claims filed by homecare workers.
