Electronic Sales Suppression (ESS) Communications pack 2024
Background
Electronic sales suppression (ESS), also known as till fraud, is where a business manipulates electronic sales records to hide or reduce the value of sales.
This is done through misusing built-in till functions or installing software and hardware specifically designed to suppress sales.
Misusing a till system reduces the recorded turnover of the business and the amount of tax a business should be paying, whilst providing what appears to be an accurate and complete record.
Key messages
Till fraud, also known as electronic sales suppression, is where a business misuses its till systems to hide or reduce sales, so it appears they owe less tax. This is tax fraud.
You are involved with till fraud if you possess or have access to an electronic sales suppression tool.
Don’t be tempted to use tools that suppress your sales. You will be charged penalties if you commit tax fraud by misusing your till system.
We can also charge you penalties if you possess an ESS tool.
The new powers available to HMRC allow them to clamp down on till fraud and help recover tax to fund our vital public services.
If businesses are using ESS, they are urged to come forward to HMRC. By making a voluntary disclosure, penalties will be reduced. If businesses do not come forward, HMRC will use full powers to recover tax evaded, apply penalties and may launch investigations that can result in criminal convictions.
HMRC use a range of methods to check for discrepancies in income, including third party information such as bank accounts, transactional data from online food ordering platforms and payments some platforms facilitate between takeaways and wholesalers.
Businesses can come forward to HMRC by searching “Make a disclosure about misusing your till system” on GOV.UK. If you suspect a business of using, producing or suppling ESS tools, HMRC encourages you to report it online, just search “Report tax fraud to HMRC”.
