Face Masks While Carrying
The most recent Stay Home Executive Order 2020-59 says, "Any individual able to medically tolerate a face covering must wear a covering over his or her nose and mouth-such as a homemade mask, scarf, bandana, or handkerchief-when in any enclosed public space." This has led to questions about the legality of wearing a face mask while legally carrying a firearm in public.
Michigan Complied Laws 750.396 says, "A person who intentionally conceals his or her identity by wearing a mask or other device covering his or her face for the purpose of facilitating the commission of a crime is guilty of a misdemeanor punishable by imprisonment for not more than 93 days or a fine of not more than $500.00, or both."
Consequently, a person legally carrying a firearm while wearing a face mask who is not facilitating the commission of a crime is not subject to the legal penalties for wearing a face mask. Note the executive order does not provide for penalties for not wearing a face mask although businesses may refuse to serve customers without one.
