We’re taking legal action to defend DACA recipients' access to health care. As a reminder, last month a small group of anti-immigrant politicians, led by Kris Kobach, challenged the Biden administration’s regulation that allows DACA recipients to obtain health coverage through the Affordable Care Act.
We refuse to let this politically motivated legal challenge succeed, so we are seeking to intervene with our co-counsel Gibson Dunn on behalf of individual DACA recipients and CASA, the largest membership-based immigrants’ rights organization in the Mid-Atlantic region. We stand with our courageous clients and together we will ensure the voices of DACA recipients — who have the most at stake — are heard loud and clear in the courtroom.
This cruel attack could deny lifesaving care to more than 100,000 community members and their loved ones. These are the same bad actors fighting to end DACA altogether and upend hundreds of thousands of people’s lives.
This fight goes beyond legal arguments — it's about protecting the health, safety, and dignity of our communities. For years, DACA recipients were unjustly excluded from accessing health care under the Affordable Care Act, despite the fact that their tax dollars help make the Affordable Care Act health insurance marketplaces possible. This year, DACA recipients finally have a chance to enroll in them in accordance with the original goals of the Affordable Care Act, and we cannot let this politically motivated challenge delay or deny access to care.
We refuse to go backwards. We will do whatever it takes to ensure access to quality, affordable health care for all.
