U.S. Attorney objects to release of defendant convicted of anti-LGBTQ+ hate crime. U.S. Attorney for the District of Columbia Timothy J. Shea, DC’s lead prosecutor, on April 7th informed his office’s Hate Bias Task Force, a citizens advisory body, that he objects to a decision by a judge to grant the early release of a defendant convicted of a bias-related assault against an LGBTQ+ person. His letter was released to the Washington Blade on April 25th. The office has a policy of not disclosing the names of crime victims in cases that it prosecutes.

Class action lawsuit demands that ICE release all transgender detainees. The Transgender Law Center (TLC) and the Rapid Defense Network filed a class action lawsuit in the U.S. District Court for the District of Columbia. The lawsuit demands the release of all transgender people in ICE custody because they are more susceptible to COVID-19. The lawsuit also states that ICE can neither provide nor implement sufficient measures to curb the spread of COVID-19 in its facilities.

FEDERAL MATTERS

Tony Fauci notes that LGBTQ+ people lifted stigma with 'incredible courage' in HIV/AIDS epidemic. Dr. Anthony Fauci said on April 7th that the visibility LGBTQ+ people brought to themselves during the height of the HIV/AIDS epidemic helped change the tide for public perception. Fauci made the remarks during the daily White House Coronavirus Task Force briefing when responding to COVID-19’s disproportionate impact on Black Americans, saying the disease has “shed a light” on health disparities in the United States much like HIV/AIDS did with LGBTQ people.

Openly gay Cabinet member Robert Grenell suggests that U.S share less intelligence with countries that criminalize homosexuality. Considered to be the only openly gay Cabinet member to place anti-discrimination issues near the top of his agenda, the acting Director of National Intelligence and former U.S. Ambassador to Germany suggested this move in an interview this week to encourage countries that currently outlaw homosexuality to decriminalize it. Critical intelligence allies that criminalize homosexuality include Egypt, Saudi Arabia and Kenya.

Administration plans to revoke trans healthcare protections. The Departments of Health and Human Services and Justice are reportedly going forward with a plan that would allow doctors and medical centers to refuse health care to the 1.2 million transgender Americans by stripping trans-inclusive protections from the Affordable Care Act’s Section 1557, which protects LGBTQ+ people and other marginalized communities from discrimination in healthcare and insurance. STATE MATTERS

Puerto Rico - Puerto Rican government sharply criticized over response to LGBTQ murders. The Puerto Rican government continues to face scathing criticism over its response to the murders of 10 LGBTQ+ people in the U.S. commonwealth over the last 15 months. Last week, two bodies found inside a charred car were identified as transgender women, marking four such deaths in the past two months.

GLOBAL MATTERS

China - Lesbian couple’s custody case takes China into uncharted legal territory. The case deals with the custody arrangement of an unmarried lesbian couple and is the first of its kind in China. The court will decide how it will determine who is each child’s mother, as one partner provided eggs for the embryos and then each carried a separate embryo to full term. Chinese law traditionally recognizes one birth parent in custody disputes, but the court will have to determine or redefine birth parental status.

Finland - Finland’s first same-sex adoptions confirmed. Finland’s first same-sex adoptions have taken place three years after the Marriage Act was reformed to allow marriage equality and same-sex adoptions. There are several same-sex couples who are engaged in required adoption counseling and others in queue.

Kenya - Ugandan LGBTQ+ individuals in Kenyan refugee camp experience violence, rape, death threats from non-LGBTQ+ refugees, and complaints go unanswered. Approximately 300 LGBTQ+ Ugandan refugees in Kenya’s Kakuma refugee camp have reported repeated violent attacks by other refugees due to being LGBTQ+ and report that police and the United Nations refugee agency (UNHCR) have failed to protect them, despite filing complaints. One victim is a 28-year-old lesbian with a two-year-old son; another is a 30-year-old gay man. Mexico - A foundation-established shelter in Tijuana for LGBTQ+ immigrants provides humane, hygienic protection for residents with COVID-19 symptoms. El Jardín de las Mariposas shelter in the Mexican border city of Tijuana has been housing about 20 LGBTTTIQ immigrants from Latin America, most of whom are transgender women. The shelter, which receives no government support, implemented new hygiene and cleaning procedures to stop the spread of COVID-19 and protect the health of its residents. These precautions are necessary, as many residents are HIV+ and are more vulnerable to the pandemic.

Morocco - Dozens of gay men are outed as photos are spread online. At least 50-100 gay men in Morocco have been outed over the last two weeks after they were identified on location-based meeting apps while sheltering at home. Some have been kicked out of their houses, and many others have been blackmailed and threatened. A Moroccan LGBTQ+ Instagram personality said that he wanted to reveal the hypocrisy of Moroccan society by showing how many gay men were living in the vicinity and encouraged the public to create fake accounts on apps to gather photos of gay men and post them.

Poland - Gay couple hands out rainbow masks on the streets of Poland. A gay couple in Poland produced and distributed hundreds of free rainbow face masks. They’ve documented their philanthropy through videos and highlighted the positive community response.

MEDIA MATTERS

Due to COVID-19, NYC Pride March canceled for the first time in 50 years. PFLAG National and chapters will be involved in the 24-hour virtual “Global Pride” on June 27th led by InterPride. PFLAG’s origin is rooted in New York when founder Jeanne Manford marched with her gay son Morty in the Christopher Street Liberation Day March, the precursor to The NYC Pride March. Therefore, we mention this historic marker for the march in Manhattan.

‘A Secret Love’ review: A lesbian couple’s enduring affection. The documentary, recently released on Netflix, explores the lives of Terry Donahue and Pat Henschel, a lesbian couple who lived as dear friends for 60 years in public and to their families before coming out.

CNN’s openly gay Anderson Cooper announces he’s a father. Born via surrogate, son Wyatt Morgan Cooper is named after Cooper’s late father. Cooper is grateful for all of those who were involved in his son’s birth.

IN CASE YOU MISSED IT

Deadline to file for COVID-19 stimulus payment for SSI/VA recipients with dependents is Tuesday, May 5th.

If you or someone you care about falls into these categories, the deadline to enter dependent information on the IRS website (in the "non-filers" portal) to receive the $500 per dependent stimulus payment this month is Tuesday, May 5th. Otherwise the payment will not be made until 2021 when the 2020 tax return is filed.

People must act if they:

  1. Did not file a tax return,
  2. Are either an individual with disabilities who receives Supplemental Security Income (SSI) or receives Veteran Administration (VA) benefits, AND
  3. Have a "qualifying child" under age 17.
