The Supreme Court’s disastrous and legally indefensible decision to give presidents wide-ranging immunity provided Trump with a mechanism to delay sentencing in his New York hush money case until this month, which led Judge Merchan to postpone sentencing until late November.
I want to make one thing clear: in Donald Trump’s criminal trials, accountability is delayed, but it is coming.
This New York prosecution was not based on official presidential acts and will not be derailed by the Supreme Court’s immunity decision. Trump’s misplaced efforts to dispose of the case should be quickly and comprehensively disposed of, and then sentencing should move forward, as it would for any other American.

John, you may be asking yourself, how does Trump keep evading accountability, and where do we go from here? You’re not alone.
I just wrote an op-ed [[link removed]] explaining how harmful the Supreme Court conservative majority’s opinion in Trump v. United States was for the pursuit of accountability – but also why we don’t need a criminal trial to know that Donald Trump was responsible for the January 6th insurrection. The work of the January 6th Select Committee showed us that. As did the finding by the Colorado Supreme Court in CREW’s 14th Amendment lawsuit that Trump incited insurrection and was therefore disqualified from the ballot.
Despite Trump’s delay tactics, we know the truth of his responsibility for the violence on January 6th, which he fueled for months with election lies.
Given the stakes—and the precedent—the Supreme Court’s conclusion that presidents enjoy presumptive immunity from criminal prosecution for official acts committed during their presidency is absolutely flabbergasting. As Justice Sotamayor said, “In every use of official power the president is now a king above the law.”
The decision itself was harmful, but so was the Court’s slow pace in handing down its immunity decision. That is largely responsible for more than 200 days of delays in Trump’s federal criminal trial for alleged January 6-related crimes.
I’m beyond frustrated that Trump’s delay tactics have worked in so many of his cases. But justice delayed does not have to mean justice denied.
That’s why CREW recently filed an amicus brief [[link removed]] calling for Judge Aileen Cannon to be reassigned in the federal classified documents case against Trump.
At every stage, Judge Cannon made the case more difficult than the law mandated, then she dismissed the case on largely unprecedented grounds, delivering a significant win to Trump. Given her apparent lack of impartiality, the case should not return to her.
These cases are too important to let them fall by the wayside. CREW will continue to fight to make sure that Trump’s sentencing and all the cases against him continue so that he can finally be held to account.
