Did you hear the news? Just over a week ago, Donald Trump was indicted yet again for trying to overturn the 2020 election – with an updated indictment rewritten to withstand the Supreme Court’s disastrous immunity ruling this summer. [1]
This marks the FIFTH time he’s been formally accused of serious crimes. It’s a sad milestone for our country – but a necessary one to establish this principle: nobody is above the law.
That’s why Common Cause is fighting to pass a constitutional amendment to overturn the Supreme Court’s ruling for good. But we need to know where members like you stand, John:
SHOULD FORMER PRESIDENTS BE IMMUNE FROM CRIMINAL PROSECUTION?
I know you might be wondering: What does this indictment mean with the Supreme Court’s recent decision to grant immunity for presidents’ actions while in office?
Well, that ruling only applies to so-called “official acts” – and this new indictment demonstrates how Trump’s actions, including conspiring to defraud the United States and overturn the 2020 election results, don’t fit that bill. [1]
That means we’ve got a new chance to hold him accountable for trying to overthrow American democracy.
Still, thanks to the Supreme Court’s decision to protect Trump, there won’t be any official verdict on his incitement of the January 6th attack before voters head to the polls this year – and that’s just wrong.
So, with our support, Rep. Joe Morelle has introduced a constitutional amendment to put it in writing: No one, not even a former president, is above the law. This amendment would also stop any president from pardoning themselves. [2]
