The American Immigration Council has a new practice advisory [[link removed]] outlining the standards of review that the Board of Immigration Appeals must use in reviewing immigration court decisions.

The advisory provides guidance about when the Board must apply de novo and clear error review. In addition, it suggests next steps to take if the Board applies the incorrect standard, which are key to ensuring that the Board does not refuse to independently assess legal and discretionary issues in your cases.
