In just a few months, the United States Supreme Court will hear arguments in a historic case that will determine the futures of countless transgender youth in this and future generations. The case - U.S. v. Skrmetti - is a challenge to a Tennessee law that bans life-saving health care for trans youth. This law, which was enacted by extreme opponents of LGBTQ equality, is a dangerous and discriminatory affront to the lives and well-being of trans youth in Tennessee and across the country and their constitutional right to equal protection under the law.
Pro-equality members of Congress - led by Senators Ed Markey of Massachusetts and Jeff Merkley of Oregon, as well as Representative Mark Pocan of Wisconsin, are leading a “friend-of-the-court” brief. This brief will argue that legislators should not ban evidence-based medical treatments that patients, their families, and their doctors all agree are the best care for the patients. Health care decisions must be made by patients, families, and doctors NOT by politicians.

Make no mistake: Laws like Tennessee’s are nothing more than an effort to deny transgender people the freedom to live their lives as their authentic selves without government interference. Every day that it and similar state laws are allowed to remain in place, they inflict further pain and injustice on trans youth and their families who are simply trying to access life-saving health care. We at the ACLU are doing everything in our power to fight back against these unconscionable attacks against our LGBTQ community
