Judge to Hear Oral Argument on the Repeal of the Religious Exemption to Vaccination for New York Children

The Honorable Denise Hartman, Supreme Court judge, will hear oral argument Wednesday, August 14th in the lawsuit filed last month by Michael H. Sussman and Robert F. Kennedy. Jr. The lawsuit challenges the constitutionality of the NY legislature’s repeal of the religious exemption to vaccination and was filed on behalf of 55 NYS families who held lawful religious exemptions.

With school only three weeks away, plaintiffs will present their case that on June 13, 2019, NYS halted more than fifty years of lawful religious exemptions from vaccination for those with genuine and sincerely-held religious beliefs. They seek judicial intervention to enjoin the repeal and permit their children back to school and camp throughout the state. The ruling will not only affect the 55 plaintiffs but thousands of other similarly situated families.

Families are encouraged to attend the hearing and, afterwards, join attorneys Sussman and Kennedy on the Albany County, NY Courthouse steps, 16 Eagle Street as they brief the press and answer questions.

Update on CA SB276 to Limit Medical Exemptions from Vaccinations

Late last week the California Medical Board (CMB) met to discuss SB276, a California bill that, if passed, would limit medical exemptions from vaccinations and route the final decision through the Department of Public Health. It would also force private patient data into a new database.

During the meeting, Board Member Kristina Lawson, J.D. made excellent points about how SB276 is not needed to combat any supposed fraud in medical exemption writing, stating that it is not the job of the CMB to police medical exemptions. She indicated she was very disturbed by the bill. Despite her remarks and robust public comment, including from members of Latinos for Medical Freedom, the Board took another vote on SB276 and voted 7-4-1 to support SB276. The bill currently sits in the Suspense file awaiting a California Assembly Appropriations Hearing on August 30th.
