AFL Files Brief in the United States Supreme Court to Protect West Virginia’s Save Women’s Sports Act |
America First Legal and its co-counsel, Christopher Mills, filed an amicus brief in defense of West Virginia’s Save Women’s Sports Act, which requires students to compete based on their biological sex. After the District Court upheld the Act as constitutional, the Fourth Circuit reversed the decision.
The Fourth Circuit’s opinion overturns the long-held understanding that “sex” in Title IX means biological sex and not “gender identity.” The Fourth Circuit held that “discrimination based on gender identity is discrimination ‘on the basis of sex’ under Title IX.” This conclusion ignores the critical distinctions between males and females we all recognize and which Title IX protects.
The Fourth Circuit’s decision destroys Title IX’s protections for girls and girls’ sports. It would require a school to permit any boy who identifies as a girl to participate in girl-only sports...

America First Legal Sues the New York District Attorney’s Office for Illegally Concealing Records on Alvin Bragg’s Partisan Persecution of President Trump |
America First Legal (AFL) sued the New York District Attorney’s Office for refusing to provide documents as requested under the New York Freedom of Information Law (FOIL) regarding District Attorney Alvin Bragg’s partisan persecution of President Trump.
In March of 2023, AFL opened an investigation into the New York County District Attorney’s Office to obtain internal and external communications from its key leaders regarding former President Trump. For example, Democrat political operative Lanny Davis bragged to Politico that he triggered the District Attorney’s investigation of President Trump. Davis’s claims might be puffery, but they provide an additional reason to believe that the District Attorney’s unusual interest in President Trump has been based on improper partisan considerations from the start...

Federal Court Rejects CBS’s Attempt to Dismiss AFL Lawsuit for Alleged Anti-White Racism |
The U.S. District Court for the Central District of California rejected CBS’ attempt to dismiss a lawsuit America First Legal (AFL) filed on behalf of its client, which alleged anti-white racial discrimination by CBS.
In February, AFL sued CBS on behalf of a heterosexual male script coordinator and freelance scriptwriter who has consistently written episodes for CBS’s “Seal Team” television series since 2017. CBS allegedly refused to hire AFL’s client as a writer for the show because he failed to check the right diversity boxes. Instead, CBS hired a black male with little experience.

Conservative watchdog notches win in court as CDC ordered to stop deleting emails |
A conservative government watchdog group secured a legal victory against the Biden-Harris administration by compelling the Centers for Disease Control and Prevention (CDC) to stop deleting employee emails they say had been done in violation of the Federal Records Act.
America First Legal, the right-leaning, Washington, D.C. based public interest organization founded by former Trump adviser Stephen Miller, sought records concerning the CDC’s endorsement of the controversial gender ideology within public schools in February 2023. In response, the CDC told AFL that it systematically deletes the emails of most employees 30 days after they depart from the agency.

America First Legal Foundation, a conservative group founded by Stephen Miller, represents Beneker. The organization has been filing complaints with the Equal Employment Opportunity Commission against major companies, including Morgan Stanley, Starbucks and McDonald’s, over corporate diversity and hiring practices that allegedly run afoul of civil rights laws.
