And, Judge Roger Benitez refused to yield to the bullying threats by California’s Attorney General Xavier Becerra to stay the order striking down the ammo registration scheme. Thus, the 9th Circuit Court granted an emergency stay late Friday night (April 24). The 9th is now in the process of reviewing the appeal from the AG, at which time they can lift the stay or make it temporary until a trial to decide the case (Rhode v Becerra). Obviously, this is a setback but one that was not unexpected given how badly Judge Benitez smacked Becerra regarding DOJ’s ammo registration failures.
