Last year, as chair of the Judiciary Committee, I subpoenaed former White House Counsel Don McGahn and others to testify as part of our constitutional responsibility to provide oversight of the Trump administration.

After the Trump administration refused to comply with my subpoenas, our ability to enforce them has been tied up in court.

Tomorrow, the full D.C. Court of Appeals will hear the case, and the stakes are incredibly high.

The power of the House to be a coequal branch and conduct oversight is at stake.

Time after time — during and since the end of impeachment — Trump administration lawyers argued that the House should have gone to court to enforce our subpoenas.

Their complete lack of principles and disregard for the rule of law is the only plausible explanation as to why they are taking a different position now.

The Constitution is clear about Congress’ right to oversight. It’s time for the courts to take notice.

If they don’t, the very foundation of our democracy is at risk.
