FIRSTNAME, on January 6th, 2021, we saw a violent mob attacking the U.S. Capitol. The goal of that insurrection was to stop the certification of the vote.
This year, the threats to election certification have only intensified. In fact, we’re seeing a more organized and sophisticated effort to slow or even thwart certification this year.
In eight different states, we’ve already seen dozens of county officials attempt to stop the certification of votes—and it’s all just practice for what it seems they plan to do this year in the presidential election.
As I told Rachel, there’s almost no question that this is going to happen—which is why we’re preparing to protect election certification now by releasing this report, identifying key states, the officials who have already posed certification threats and the legal remedies available.
The good news? Refusing to certify election results is clearly illegal in *all* of these eight key states. And there are steps that can be taken to enforce the law, which we laid out in detail in the report.
There’s also a lot that we can do now to prepare: As I explained on MSNBC, we need state election boards, secretaries of state, attorney generals and local prosecutors to explicitly tell county officials that they do not have the discretion to refuse to certify the election.
One state has even provided a roadmap: Michigan’s Secretary of State and other officials have been very clear that the law provides for legitimate ways to challenge elections if there are questions about fraud or the county's vote, but delaying or refusing county certification is not one of those ways.
In Michigan, authorities have told county officials that if they do refuse to certify the results, there will be consequences. That should happen across the country.
John, this is important because if they *do* try to disrupt the election, and if they are prosecuted or challenged civility, they won’t be able to claim that they didn't understand the law.
We put out this report to make all of this easier. We laid out the roadmap to protect the 2024 election and the threats to certification in key states. And we’re going to keep our focus on this issue as long as it takes.
