Rev. Brian Wharton was the supervising detective on Robert’s case who testified for the prosecution and helped send Robert to death row in 2003.
Now, even he’s convinced that no crime occurred and that Robert is innocent.

But Brian isn’t the only one who now believes there was no crime. Leading specialists in neuropathology, forensic pathology, lung pathology, biomechanical engineering, medical toxicology, and pediatric radiology have also determined that Robert’s daughter, Nikki, died of natural and accidental causes.
Since 1992, at least 32 parents and caregivers in 18 states have been exonerated after being wrongfully convicted under the shaken baby hypothesis.
So why is Robert still on death row? The trial court ignored new evidence from expert witnesses and relied almost exclusively on outdated scientific evidence introduced at his 2003 trial to uphold his conviction.

John: Robert has never had a true chance at justice in this case. His federal right to due process and a fair trial were violated by the state’s introduction of false and misleading forensic science. Today, science supported by studies and empirical testing has exposed that no crime occurred here — and Robert deserves to have his actual innocence claim fairly considered before it’s too late.
