Election experts agree on three points: (1) In a head-to-head general election contest, Trump faces the same challenges to winning the popular vote as he has in the past, perhaps worse; (2) independent third-party candidates on the ballot siphoning away votes gives Trump the best possible chance of winning reelection by winning the Electoral College; and (3) Trump says he will continue to seek reelection even if he is convicted of crimes. We can’t just hope that this threat will go away or that the courts will act in time to remove Trump from the ballot.
But we do have one simple way to checkmate these efforts. The National Popular Vote Interstate Compact (NPVIC) is an agreement among a group of U.S. states and the District of Columbia to award all their electoral votes to whichever presidential candidate wins the overall popular vote in the 50 states and the District of Columbia.
Minnesota was the latest to join, giving NPVIC 16 states plus DC, accounting for 206 electoral votes and 76% of the states needed to essentially make the popular vote the law of the land. We need to get over the top in the other states considering joining, like Maine and Michigan, to make the popular vote a reality.
