Topic: Proposal (CR-102) – Factory Assembled Structures (FAS) Fees Increase (FY25)
Brief Description: The purpose of this rulemaking is to propose amendments to FAS rules to increase fees by the fiscal growth factor rate of 6.40%. The fee increase is the maximum allowed by the state Office of Financial Management for fiscal year 2025. A fee increase is needed to cover operating costs for the FAS Program. The current fee levels are insufficient to cover current FAS Program expenses. The increase will ensure that revenues match expenditures.

Division: Fraud Prevention and Labor Standards (Apprenticeship Program)
Topic: Proposal (CR-102) – Apprenticeship: Standards Submittal Deadline (E2SSB 5600 Implementation)
Brief Description: The purpose of this proposed rulemaking is to adjust the submission deadline for when an apprenticeship program submits proposed new program standards or changes to their existing apprenticeship program standard(s). The proposed rule change would adjust the submission deadline from 45 days to 60 days before the next regularly scheduled Washington State Apprenticeship and Training Council (WSATC) meeting.
The Washington State Legislature passed Engrossed Second Substitute Senate Bill 5600 (Chapter 156, Laws of 2022) concerning the sustainability and expansion of state registered apprenticeship programs (RCW 49.04.240). Industry sector platforms that collaborate with and support apprenticeships must review proposed standards when submitted by an apprenticeship program and provide a recommendation to the Washington State Apprenticeship Training Council (WSATC) for consideration in approving or denying the proposed apprenticeship program standards. This rulemaking would adjust the deadline to allow adequate time for the additional level of review.

Division: Fraud Prevention and Labor Standards (Employment Standards)
Topic: Preproposal (CR-101) – Equal Pay and Opportunities Act (SHB 1905 Implementation)
Brief Description: The purpose of this rulemaking is to implement new Washington Equal Pay and Opportunities Act (EPOA) requirements, as well as clarify existing requirements. The Washington State Legislature passed Substitute House Bill 1905 (SHB 1905), Chapter 353, Laws of 2024, which goes into effect on July 1, 2025. The bill significantly expands the existing worker protections against pay and promotion discrimination based on gender under the EPOA (chapter 49.58 RCW) by broadening its protections to include 14 protected classes.

Topic: Preproposal (CR-101) – Pension Discount Rate (PDR) 2025
Brief Description: The purpose of this rulemaking is to amend WAC 296-14-8810 Pension tables, pension discount rate and mortality tables, by lowering the pension discount rate (PDR) to better align with the rate of return for long-term treasuries for self-insured pensions. These reductions allow our financial statements to more accurately reflect our liabilities and overall financial position, and are consistent with recommendations from our annual independent actuarial review of our rate making.
