NOTICE OF RULEMAKING

Notice is hereby given that the Superintendent of Insurance will hold a public hearing in a hybrid format on August 28, 2024 at 10:00 a.m. in the Central Conference Room of the Department of Professional and Financial Regulation building, 76 Northern Avenue, Gardiner, Maine to receive comments concerning proposed amendments to Rule Chapter 850 ? Health Plan Accountability. The link to register for the hybrid meeting will be posted on the Bureau?s website on the Public Event Notices page.

The purpose of the proposed amendments is to conform the rule to reflect amendments to the Maine Health Plan Improvement Act enacted by Public Law 2021, Chapter 603 and by Public Law 2023, Chapter 680, and to comply with new federal requirements imposed by the Department of Health and Human Services (HHS) Notice of Benefit and Payment Parameters for 2024.

The amendments are proposed in accordance with 24-A M.R.S. ?? 212, 2772, 2774, 4218, 4218-A, 4222-A, 4303, 4309, and 4309-A.

Primary sources of information relied upon by the Bureau of Insurance in developing the proposed amendments include P.L. 2021, Ch. ?603, P.L. 2023, Ch. 680, and Bureau staff?s professional judgment.??

All interested persons are invited to provide oral comments at the hearing or to submit written comments.?
