Marcellus has spent nearly 24 years on Missouri's death row seeking to prove his innocence. But even though the prosecuting attorney has reviewed new DNA results, concluded that these results prove Marcellus did not murder Ms. Felicia Gayle, and filed a motion to vacate Marcellus' conviction — Missouri's Supreme Court still set an execution date.
John: No court has ever considered the DNA evidence that proves Marcellus' innocence. That's why we're calling for a stay of execution to give Marcellus the fair chance at justice that he deserves.
A stay would give the court time to carefully consider the exculpatory DNA evidence and assess the prosecutor's assertion that there is "clear and convincing evidence" of Marcellus' innocence.
