Small Scale Multi-Unit Housing Legislation Compliance Update
BC Government

Last week, the province announced an update on municipalities' compliance with the Small-Scale Multi-Unit Housing (SSMUH) legislation. Since the compliance deadline of June 30, 2024, nearly 90% of municipalities across the province have adopted or are in the process of adopting bylaws in compliance with the province's SSMUH legislation, which was introduced last year.

Out of a total of 188 municipalities:
  • 162 have adopted bylaws in compliance with the legislation
  • 9 are actively working on adoption
  • 15 have requested a formal extension, which are being reviewed by the province
    • The only extensions granted so far are for the Northern Rockies Regional District, District of Wells, and Greenwood
    • The Township of Langley's and Mount Waddington Regional District's applications for extensions have been rejected and both municipalities now have 90 days from the date of the rejection letter to comply
  • 1 municipality has chosen not to comply (i.e., District of West Vancouver)
The District of West Vancouver has been given a 30-day notice to comply before a ministerial order may be issued to bring the municipality into compliance. This is a strong response from the province, especially compared to the notice period outlined in its policy manual, which prescribes a 90-day notice period prior to a ministerial order being issued.
