LCB Actions: Cannabis Related Rulemakings
On July 17, 2024, during its regularly scheduled meeting the Liquor and Cannabis Board (LCB) took the following cannabis-related actions:
Proposed rules on medical cannabis excise tax exemption implementation (Substitute House Bill 1453): Proposed rules filed – Public comment period now open
The Board approved a rule proposal (CR 102) to amend several sections of Title 314 WAC and create a new rule section (WAC 314-55-090) to implement Substitute House Bill 1453 (chapter 79, Laws of 2024) which provides a cannabis excise tax exemption for medical cannabis patients under certain conditions. The proposed rule changes are identified in the CR 102 memorandum and the CR 102 form links below.
Transfer of authority for accreditation of cannabis testing laboratories (implementing 2SHB 2151): Preproposal Statement of Inquiry (CR 101) Filed
The Board approved a Preproposal Statement of Inquiry (CR 101) to consider amending sections of chapter 314-55 WAC to implement 2SHB 2151 (chapter 69, Laws of 2024) and HB 1859 (chapter 135, Laws of 2022) related to the transfer of authority of cannabis laboratory standards and accreditation to the Washington State Department of Agriculture – 2SHB 2151 went into effect on July 1, 2024.
The LCB is looking forward to receiving stakeholder feedback and input on this topic during the rulemaking process.
