Last month, the Supreme Court overturned Chevron deference, the foundation of modern administrative law. It guides courts to defer to the expertise of federal agencies when dealing with ambiguities in the specifics of regulations. For example, judges, not experts, may now be forced to handle technical questions [[link removed]] about equipment use or complex questions [[link removed]] about how weather patterns impact downwind air pollution.
In throwing it out, they obliterated 40 years of precedent and upended our entire system of reasonable regulatory checks on corporate power.
