Subject I expect better from the courts, and you should too

When the founders signed the Declaration of Independence, they didn't have everything figured out. Far from it. Medicaid wasn't around, the interstate highways were still more than a century away, and modern America would have been incomprehensible. But they knew one thing for sure: an autocratic form of government has no place in this land.

With their blood, sweat, and genius, they built the foundations of our country. Not every decision they made was perfect or just. But, they had the foresight to make the rule of law an underpinning of our Republic. So, over more than two centuries, we solidified and reinforced the rule of law by expanding its protections and enforcing its legal codes and precedents.

That is, until this week.

On Monday, in a 6-3 decision, the United States Supreme Court ruled that presidents are no longer subject to the rule of law when acting in their "official capacity," a term that could be very broadly interpreted. This decision grants sweeping immunity from prosecution to any president, regardless of party affiliation, and bestows unprecedented power.

The founders would be appalled by this ruling, as it gives the president a monarch-like authority, contrary to what they envisioned. In fact, it's what they explicitly fought against.

Let me be clear: This isn't partisan, John. No president – regardless of politics or party – should be above the law. Providing anyone with this level of blanket immunity is a dangerous precedent to set.

SCOTUS may have forgotten that, but we have not. Now it is our responsibility to elect leaders who — despite their awesome power — know to stay on the side of justice and freedom, not autocracy and cronyism. And maybe even to do it with some measure of humility.

I expect better from the courts, Congress, and all of our elected officials — including myself — than what I saw this week. And you should too.
