Today, the Supreme Court ruled that Donald Trump is immune from prosecution for official acts while in office even if they violate criminal law.
We’ve long said that Donald Trump’s attempts to claim absolute immunity do not hold up to even the barest scrutiny – and the Supreme Court validating his absurd claims is frankly dangerous and devastating.
This throws the future of Trump’s federal criminal case into question.
Trump will likely still face charges for some of his efforts to overturn the 2020 election and his incitement of the insurrection. But it will require the District Court to move forward as quickly as possible to determine where immunity does and doesn’t apply in order to try the case this year.
Even more concerning, this decision threatens our system of democratic checks and balances. If presidents are immune from prosecution for official acts, that puts them above the law and above oversight from the courts. This will have implications for every future president—not just Donald Trump.
We’re reviewing the Supreme Court’s full decision now, and there’s more to come about what this means both for Trump’s trials and for the future of our democracy. What is clear is that outside watchdogs like CREW are going to be more important than ever.
Now that Trump’s criminal trial for January 6th charges is in limbo, our civil case challenging his eligibility for the ballot under Section 3 of the 14th Amendment takes on new importance.
Our case is so far the only time that Trump has faced trial in a court of law for his role in inciting the insurrection.
Our case featured eyewitnesses, experts, documents, video and a whole lot of vigorous process. The trial court found that the evidence demonstrated Trump did engage in insurrection. The Supreme Court let him off on a technicality, but did not touch the facts of his incitement.
This is the kind of work only CREW can do. We filed the complaints that led to evidence submitted in the New York trial. We brought the lawsuit that established Trump as a disqualified insurrectionist. And we will keep up this work, no matter what comes next in this dark time for our democracy.
