It's being called "one of the most momentous decisions of our lifetime."^1
No, we're not talking about the Donald Trump immunity case, although that
will have far-reaching ramifications. We're referring to the Supreme
Court's decision in Loper Bright Enterprises v. Secretary of Commerce,
which overturned a 40-year precedent—the Chevron doctrine—that gave expert
federal agencies the ability to implement critical health, safety, and
consumer protections.
Air pollution. Food safety. Monopolies and corporate power. Regulations we
depend on to be able to live our lives in safety and comfort are in danger
of being overturned.^2
The Loper decision is a gift to corporate America and the billionaires who
have been bribing Supreme Court justices. The court is illegitimate, and
we cannot depend on it to protect our rights.
Congress has the power to rein in the Supreme Court. Congress can pass new
rules governing the court, including establishing an ethics code with real
teeth or even expanding the court to minimize the MAGA justices'
influence. A razor-thin margin separates Democrats and Republicans in
Congress, and MoveOn's proven election program will make the difference in
ensuring Democrats control Congress—if we have the funds to see it
through.

What the MAGA Supreme Court majority said in Loper is that if any part of
a law is left to interpretation, agencies, including the Department of
Justice and the Environmental Protection Agency, no longer have the leeway
to make that decision.^3 So now, for example, when the EPA tries to rein
in pollution with an emissions rule under the Clean Air Act, a corporation
can just sue and have the rule knocked out.
This is why Harlan Crow spent millions courting Justice Clarence Thomas.^4
This is why corporations paid Justice John Roberts' wife millions to
"consult."^5 This is what the luxury gifts to Justice Samuel Alito
bought.^6
The Loper decision is the tool Trump can use to ensure he achieves "the
largest regulation cut in history" he promised FOUR times in Thursday's
debate.^7
We cannot let Trump reach the White House again under a Supreme Court
ready to give him such blanket legal cover to destroy our nation's
protections. But we also have the power to put a stop to this
off-the-rails Supreme Court MAGA majority, by electing a Congress willing
to finally rein them in.
