Immunity Upheld       DEFENDING KANSAS SAVING AMERICA   DONATE VOLUNTEER KSGOP UPDATE Important Information   Supreme Court Affirms Presidential Immunity for Official Acts The Supreme Court of the United States ruled today that Donald Trump, along with all U.S. Presidents, possesses what is known as absolute presidential immunity within the confines of his official duties and acts. This legal protection shields presidents from liability for decisions made in their official capacity as the nation's leader. The Supreme Court's 6-3 decision aligns and agrees with the arguments presented in the Kansas Republican Party amicus brief submitted to SCOTUS, as brilliantly written by Chris McGowne, Esq., KSGOP counselor. The following signed onto the submitted amicus brief in full support: Kansas Republican Party Colorado Republican Party Delaware Republican Party Georgia Republican Party Idaho Republican Party Maine Republican Party Michigan Republican Party Nebraska Republican Party North Dakota Republican Party Oklahoma Republican Party Rhode Island Republican Party West Virginia Republican Party Wisconsin Republican Party Wyoming Republican Party These states joined with the KSGOP to contend that, when acting within an official capacity, presidents cannot be prosecuted for actions performed in the line of duty on behalf of the United States. However, the Court clarified that presidential immunity does not extend to acts conducted in a personal capacity. Presidents remain accountable for individual actions and cannot claim immunity for such deeds. This decision changes or kills many of the sham trials currently underway in New York and Georgia. The Supreme Court held that: “Under our constitutional structure of separated powers, the nature of Presidential power entitles a former President to absolute immunity from criminal prosecution for actions within his conclusive and preclusive constitutional authority. And he is entitled to at least presumptive immunity from prosecution for all his official acts. There is no immunity for unofficial acts.” Specific to the events leading up to and including January 6, 2021, SCOTUS wrote, “And the President cannot be prosecuted for conduct within his exclusive constitutional authority. Trump is therefore absolutely immune from prosecution for the alleged conduct involving his discussions with Justice Department officials.” This is a huge win for Donald J. Trump personally, as a former and the next POTUS, and for the Trump presidential campaign. President Trump on Truth Social posted, “Big win for our constitution and democracy.
