Another TERRIBLE decision

Today, the right-wing Justices on the Supreme Court stripped the responsibility for interpreting ambiguous laws from hundreds of federal agencies in the Executive Branch and instead gave that power to themselves and the courts.

The New York Times reports, "The decision could lead to the elimination or weakening of thousands of rules on the environment, health care, worker protection, food and drug safety, telecommunications, the financial sector and more…."

This titanic shift in power from the Executive Branch to the Judicial Branch has been a top priority for giant corporations and the right-wing billionaires that have showered millions of dollars of "gifts" on Justices Thomas and Alito – and is still more evidence that this Supreme Court is corrupt, faces a legitimacy crisis, and requires binding ethics reform.

John, nothing can be done to rein in this extreme Supreme Court if we lose the Senate. If anything, it gets worse.

The sweep of today’s ruling is almost unimaginable. In addition to calling the decision a "a boon for banking lobbyists," The New York Times reports on likely impacts:

"The oversight of food, drugs and tobacco is expected to be a target…

"Environmentalists fear the elimination of hundreds of E.P.A. rules aimed at limiting air and water pollution, protecting people from toxic chemicals and, especially, tackling climate change…

"Conservative Christian activists and lawyers are celebrating the decision as a significant win for their ambitions to target medication abortion and rights for transgender people…

"Complicate the ability of the Treasury Department and the Internal Revenue Service to craft federal regulations that are central to President Biden’s economic agenda…

"Make it harder for the government to enact workplace safety regulations and enforce minimum wage and overtime rules….

"Affect how Medicare, Medicaid and Affordable Care Act insurance plans are administered…"

This Supreme Court wants us to believe that George Washington and the other founders of our country wanted today's kids to drink more polluted water, today's workers to be hurt more on the job, and today's government agencies to be hogtied from doing the jobs past Congresses and Presidents gave them.

In her dissent, Justice Kagan disagrees, saying the conservative majority "disdains restraint, and grasps for power," making "a laughingstock" of precedent and producing "large-scale disruption" throughout the entire government.

"In one fell swoop," Kagan continues, "the majority today gives itself exclusive power over every open issue — no matter how expertise-driven or policy-laden — involving the meaning of regulatory law. ... The majority turns itself into the country’s administrative czar."

Democratic control of the Senate in 2024 is the only path forward to address the corruption of this Supreme Court.
