Sens Smith, Klobuchar and Senate Democrats Seek to Repeal Comstock Abortion Rule, Fearing Trump Crackdown

Senate Democrats are seeking to overhaul an 1873 federal law that bans abortion-related materials from being sent through the mail, worried that a future Trump administration could invoke the Comstock Act to crack down on abortion access or effectively ban the procedure altogether.
“There is a very clear, well-organized plan afoot by the MAGA Republicans to use Comstock as a tool to ban medication abortion, and potentially all abortions,” said Sen. Tina Smith (D-Minn.), who on Thursday introduced legislation to repeal the Comstock Act’s abortion provisions. “My job is to take that tool away.”
Democrats’ push to defang the 151-year-old law comes less than five months before a presidential election in which reproductive rights appear destined to play a defining role. But the party’s mixed reaction to the plan underscores the balancing act between policy aspirations and political realities.

There are No Pro-Abortion Rights OB-GYNs in Congress. These Candidates are Hoping to Change That.

As Congress grapples with abortion rights two years after the Supreme Court overturned Roe v. Wade, two physicians specializing in obstetrics and gynecology are hoping to bring their expertise and exam room experiences to Capitol Hill.
Dr. Kristin Lyerly and Dr. Kelly Morrison are running for Congress for the chance to become the only pro-abortion rights OB-GYNs on Capitol Hill.
Morrison, who is running in Minnesota’s 3rd District and also currently serves in the state Legislature, expressed similar sentiments. She is the sole candidate in the state’s Democratic primary, which is also on Aug. 13. She is likely to face Tad Jude, a lawyer and former Minnesota state lawmaker, in November.
“OB-GYNs and other care providers see firsthand what [abortion] bans and restrictions do to people’s health,” said Morrison, who has been a practicing OB-GYN for over 20 years, adding: “When I talk to my colleagues in states that have enacted these bans and restrictions, it’s really terrifying what’s happening in those areas.”

Representative Finke Discusses Minnesota’s New Law Banning Book Bans on NBC News NOW

Last week, Representative Leigh Finke joined the hosts of NBC Now to discuss Minnesota's new ban on book bans passed this last session, HF4373.
Minnesota is one of several states where lawmakers are now pursuing bans on book bans. The Washington and Maryland legislatures have also passed them this year, and Illinois in 2023.
According to the American Library Association, over 4,200 works in school and public libraries were targeted in 2023, a jump from the old record of nearly 2,600 books in 2022. Many challenged books — 47% in 2023 — had LGBTQ+ and racial themes.
Restrictions in some states have increased so much that librarians and administrators fear crippling lawsuits, hefty fines and even imprisonment if they provide books that others regard as inappropriate. Already this year, lawmakers in more than 15 states have introduced bills to impose harsh penalties on libraries or librarians.

Abortion Debate Shifts as Election Nears: ‘Now It’s About Pregnancy’

In the decades that Roe v. Wade was the law of the land, abortion rights groups tried to shore up support for it by declaring “Abortion Is Health Care.”
Only now, two years after the Supreme Court eliminated the constitutional right to abortion, and just six months before the presidential election, has the slogan taken on the force of reality.
The public conversation about abortion has grown into one about the complexities of pregnancy and reproduction, as the consequences of bans have played out in the news. The question is no longer just whether you can get an abortion, but also, Can you get one if pregnancy complications put you in septic shock? Can you find an obstetrician when so many are leaving states with bans? If you miscarry, will the hospital send you home to bleed? Can you and your partner do in vitro fertilization?
That shift helps explain why a record percentage of Americans are now declaring themselves single-issue voters on abortion rights — especially among Black voters, Democrats, women and those ages 18 to 29. Republican women are increasingly saying their party’s opposition to abortion is too extreme, and Democrats are running on the issue after years of running away from it.
