In a leaked decision, we’re learning that The Supreme Court has just ruled 6-3 to uphold EMTALA, preserving the 40-year-old law that requires hospitals to provide emergency abortion care.
This victory is a testament to our relentless activism and the power of our feminist movement. This is our win.

What the leaked decision tells us: Hospitals in Idaho must provide emergency abortion care when necessary to prevent serious health risks, regardless of state law. This decision ensures that women facing a health emergency can get the care they need, including abortions, without interference from politicians who oppose care for pregnant people.
This is our win: This win belongs to every single one of us who took action, sent endless streams of letters to SCOTUS, and put our bodies on the line. Thank you for standing up and fighting back against the far-right MAGA agenda hell-bent on stripping women of our freedoms.
What’s next: We need to continue sending an unmistakable message to SCOTUS: Women’s lives should not be pawns in MAGA’s culture war. Justice Ketanji Brown Jackson cautioned that while positive, this decision is "not a victory" but a delay, as "pregnant people experiencing emergency medical conditions remain in a precarious position."
For today, let’s celebrate this win.
