John, the Supreme Court is taking shots at marriage rights now.

 

By a 6–3 vote, the conservative majority ruled today that if your husband or wife isn’t a citizen, then the government can keep them out of the country without even telling you why.

 

More broadly, the constitutional rights that apply to married Americans are invalid if your spouse is from another country.

 

Justice Sonia Sotomayor wrote a dissenting opinion to this decision, and it’s a dire warning to gay Americans like me. Here’s why.

 

The 2015 case Obergefell v. Hodges legalized same-sex marriage nationally, but that ruling was actually a win for every American.

 

Obergefell did for marriage rights what Roe did for reproductive rights: it was the first legal documentation that all Americans have the “basic civil right” to marriage.

 

Today when the conservative justices ruled against Sandra Muñoz, whose husband of 14 years lives in El Salvador, the Supreme Court decided for the first time that there are some exceptions to Obergefell

 

Sotomayer believes my rights will become an exception next.

You might not remember the time leading up to the Obergefell case, but I do. 

 

Republicans spent years comparing legalizing same-sex marriage to letting people marry children, calling gay men pedophiles (now they call us groomers), and campaigning on promises to fight “the gay agenda.”

 

We won that fight, but Republicans never stopped fighting. My opponent’s website proudly claims that he is against my guaranteed right to marriage.

Trust me, it’s not just Mike. Justices John Roberts, Clarence Thomas, and Samuel Alito tried to block same-sex marriage, and their opinions haven’t changed.

 

Four years ago, Supreme Court Justice Clarence Thomas wrote in a dissenting opinion that Obergefell must be overturned because it had “ruinous consequences for religious liberty.” 

 

Two years ago when the Court threw out Roe v. Wade, Thomas wrote that it’s time to “reconsider” the 2015 decision on marriage rights, also.

 

John, whatever you may call what’s happening in our country – extremism, Christian nationalism, or fascism – there’s no denying that we are witnessing the U.S. slide back in time to before the Civil Rights era.

 

With Project 2025 creeping closer each day, this election may be our last chance to stop the reversal of our freedoms and the proposed criminalization of gender and sexual minorities. 

 

Please, whatever you can manage, I need you with me to unseat Mike Simpson and give LGBTQ+ Americans more representation in Congress before it’s too late.
