The Supreme Court of the United States has been making headlines, but it’s not the only Court we should have our eyes on. In 2024, 33 states will have State Supreme Court elections, which will determine who serves in these powerful judicial positions.
That’s right: in many states across the country, these are elected roles.
And the cases these courts hear have a seismic impact on our reproductive freedom. For instance:
- In 2022, the Michigan Supreme Court allowed a ballot measure to proceed that gave voters the chance to enshrine abortion rights in the State Constitution—and they did!
- Earlier this year, the Pennsylvania Supreme Court revived a case that could expand insurance coverage of abortion and help patients with lower incomes access care.
- Also earlier this year, the Florida Supreme Court upheld the state’s fifteen-week abortion ban in a case that cleared the way for a six-week ban.
As legislative attacks on our fundamental rights expand in their scope and intensity, we cannot afford to overlook the importance of judicial elections. Across the country, these courts are slated to hear cases related to abortion access, birth control access, voting rights, the future of IVF and more.
Through our Care is Not Criminal campaign, we’ve helped elect pro-choice judicial nominees in places like Wisconsin, Michigan, and Pennsylvania—and we’re not slowing down.
These races are one more proof point of how important it is to participate in every race, every Election Day, everywhere.
