Another victory! Our clients, Jeremy and Kristy Morris, just won for religious freedom at the 9th Circuit Court of Appeals.
Jeremy and Kristy hosted an annual Christmas display at their home near Hayden, Idaho, asking visitors for donations to charities that serve children with cancer and children who have been victims of abuse and neglect.
When they moved to a new home in 2014, their homeowner’s association ordered them to take down their Christmas display.
After the HOA tried to block the display, the Morrises sued. An Idaho jury found that the HOA discriminated against the Morrises because of their religion, awarding them $75,000 in damages.
But the judge overruled the jury’s verdict, imposed an injunction preventing Jeremy and Kristy from decorating their home for Christmas, and imposed thousands of dollars of attorney’s fees on the Morrises.
First Liberty, along with volunteer attorneys from Gibson Dunn & Crutcher, appealed the judge’s ruling. Allyson Ho, partner at Gibson Dunn, argued the case before the 9th U.S. Circuit Court of Appeals in 2020.
This week, the 9th Circuit sided with religious freedom and reversed the lower court ruling against Jeremy and Kristy.
We are grateful to all the attorneys in our volunteer attorney network, especially Allyson Ho, for fighting for the rights of every family to celebrate the Christmas season without fear of retribution in their very own neighborhood.
Will you help secure every families’ freedom to celebrate the Christmas season without fear of retribution?
