Division: Field Services and Public Safety (Factory Assembled Structures Program)
Topic: Adoption (CR-103) – Factory Assembled Structures (HB 1514 & SB 5089 Implementation)
Brief Description: This rulemaking amends the Factory Assembled Structures (FAS) rules under Chapter 296-49A WAC, Director’s Factory Assembled Structures Advisory Board; Chapter 296-150P WAC, Recreational park trailers; and Chapter 296-150R WAC, Recreational vehicles. The amendments affect L&I’s FAS Advisory Board, and distributing inspection insignia to manufacturers of recreational vehicles. Amendments implement House Bill 1514 (HB 1514), Chapter 78, Laws of 2023; and Senate Bill 5089 (SB 5089), Chapter 36, Laws of 2023.
HB 1514 allows recreational vehicles (RV’s) and recreational park trailer manufacturers with an agency approved Quality Control Program to request and purchase insignia while their plans are under review by the FAS Program.
SB 5089 was an L&I request bill that amends membership for the FAS Advisory Board. Amendments include:
- Increasing the number of board members from nine to at least 11.
- Adding a representative for allied trades such as electricians, plumbers and contractors.
- Adding diversity considerations for Board appointments.
- Requiring members to apply for reappointment if serving consecutive terms.

Division: Fraud Prevention and Labor Standards (Apprenticeship Program)
Topic: Preproposal (CR-101) – Apprenticeship: Standards Submittal Deadline (E2SSB 5600 Implementation)
Brief Description: The purpose of this rulemaking is to consider amending WAC 296-05-008, Meetings and adjudicative proceedings, to adjust the submittal deadline for apprenticeship programs requesting new program standards or changes to existing standards. The change is based on implementation of Engrossed Second Substitute Senate Bill 5600 (Chapter 156, Laws of 2022) concerning the sustainability and expansion of state registered apprenticeship programs (RCW 49.04.240). Industry sector platforms that collaborate with and support apprenticeships must review proposed standards when submitted by an apprenticeship program and provide a recommendation to the Washington State Apprenticeship Training Council (WSATC) for consideration in approving or denying the proposed apprenticeship program standards. This rulemaking would adjust the deadline to allow adequate time for the additional level of review.

Division: Insurance Services (Employer Services)
Topic: Preproposal (CR-101) – Industrial Insurance Premium Rates for 2025
Brief Description: The purpose of this rulemaking is to update Chapter 296-17 WAC, General Reporting Rules, Audit and Recordkeeping, Rates and Rating System for Washington Workers’ Compensation Insurance; and Chapter 296-17B WAC, Retrospective Rating for Workers’ Compensation Insurance.
Labor & Industries is required by law to establish and maintain a workers’ compensation classification plan, and to set premium rates that are: 1) the lowest necessary to maintain actuarial solvency of the accident and medical aid funds; and 2) designed to attempt to limit fluctuations in premium rates. The plan must be consistent with recognized principles of insurance. L&I is also required by law to offer retrospective rating plans to employers as a further incentive to encourage workplace safety and prevent employee injury.
