Huge news from the immigration world today: President Biden took decisive action that could protect hundreds of thousands of undocumented immigrants who are married to US citizens. This would not have been possible without the tireless organizing of immigrant communities and allies.
Once implemented, the policy will protect undocumented spouses from deportation, give them work permits, and put them on a path to citizenship if they have lived in the US continuously for 10 years. As many as 500,000 immigrants could benefit.
Many people believe that simply marrying a US citizen is enough to grant an undocumented person legal status. But as you may well know, there are all kinds of bureaucratic obstacles that stand in the way, which sometimes bar the spouses from obtaining status altogether.
With this move, President Biden is using his legal authority to remove some of these barriers. This will help longtime immigrants become citizens and provide stability for countless American families and children.
Furthermore, the President will be distinguishing himself from Donald Trump and the GOP — who only want to separate families via mass deportations.
The American people support common-sense immigration solutions like today's policy announcement. Seventy-four percent of Americans support a balanced approach to immigration, which addresses border security AND provides a path to citizenship for long-settled immigrants.
Today's action is the biggest news on immigration in a decade — since President Obama announced Deferred Action for Childhood Arrivals (DACA) in 2012 and Deferred Action for Parents of Americans (DAPA) in 2014. Like those programs, today's action will almost certainly be challenged in court. At this time, we don't know when the Biden administration will be able to implement this action.
