Justice Thomas’s wife had direct involvement in plans to overthrow the 2020 election, and Justice Alito displayed flags outside of his homes showing support for the insurrection. Their actions have cast doubt on their ability to rule fairly and without bias in cases tied to such politically charged events.
Recusal is not just a legal formality, it is a crucial step in ensuring the impartiality of our judges. This is especially important for U.S. Supreme Court justices, who currently have no binding codes of ethics to keep their conflicts of interest in check. It is a necessary measure to maintain public trust in our judicial system.
